President Joko Widodo is considered to have lied to the public through his statement which does not compromise corruption eradication. There are at least five things highlighted by the Indonesian Legal Aid Foundation (YLBHI) as President Jokowi's lies.
First, YLBHI assesses that the President has weakened the eradication of corruption through the weakening of the KPK by appointing a problematic committee that has a conflict of interest.
"Also, it does not evaluate the work of the committee when there is an indication that the committee will elect a candidate for leadership with problems, namely by passing the candidates that do not meet the criteria of article 29 of Law 30/2002 and not listening to the voice of the people who are mandated by the KPK Law and Presidential Decree No. 54 / P of the Year 2019 regarding the KPK Leadership Selection Committee," said YLBHI Executive Director, Asfinawati through a press release today, (16/9/2019).
Second, four points that the President did not approve of the KPK Law Revision were also considered to be meaningless. Because, the most important thing has been agreed that the KPK is no longer an independent institution. The KPK Law revision regulates that KPK employees become state civil servants (ASN).
According to Article 1 number 1 of Law 5/2014 concerning State Civil Apparatus referred to as ASN is a profession for civil servants and government employees with work agreements working for government agencies.
"This means that the KPK will become part of the government. Whereas the KPK's investigation and prosecution functions include corruption cases involving law enforcement officials, state administrators, and other people related to corruption committed by law enforcement or state administrators as regulated in article 11a of Law 30/2002," she said quoted tempo.co.
Third, Asfinawati assessed that Jokowi's disapproval of the KPK that was required to coordinate with the Attorney General's Office was only a sweetener. If the investigation and investigation have been weakened, there will never be prosecution. So according to him, the rejection of the prosecution actually had no effect whatsoever to strengthen the KPK's corruption eradication function.
The fourth point, Jokowi's disapproval of the origin of investigators and investigators is not only from the National Police and the Prosecutors' Office, not a reinforcement, but stagnation. According to Asfina, if you want to strengthen the investigator and all investigators should be independent. Nor did it close the opportunity for investigators from the National Police and the Attorney General's Office but the conditions were to resign from their original place.
"This is important to maintain a conflict of interest because what is investigated is likely to come from the National Police and the Prosecutor's Office. Members of the National Police and the Prosecutor's Office who have integrity in eradicating corruption can carry out reforms from within. In this way, law enforcement that is free of corruption and professionals is quickly realized," she said.
Fifth, Jokowi's decision to maintain the management of LHKPN at the KPK by weakening the investigation function was also considered by YLBHI not to be a reinforcement. This position is the same as the position of some problematic KPK candidates and can be seen as a plan to change the KPK's function from enforcement to prevention.
"Based on the above matters, YLBHI asks the President not to play around with the people's mandate that has been obtained, one of which is through a campaign of partisanship against corruption eradication," she said.
